These Terms of Use and Platform Access Agreement (the "Terms") govern access to and use of the civic liturgy. research platform, including all related software, datasets, reports, briefings, dashboards, analyses, scores, indices, methodologies, frameworks, and outputs (collectively, the "Platform"). The Platform is owned and operated by Civic Liturgy, LLC, an Arkansas limited liability company with offices at 308 NW 6th Street, Bentonville, Arkansas 72712 ("Civic Liturgy," "we," "us," or "our"). By accessing or using the Platform, or by signing the acknowledgment below, you ("User" or "you") agree to be bound by these Terms.

Agreement Required

By accessing or using the Platform, or by signing the acknowledgment, you enter into a legally binding agreement with Civic Liturgy, LLC. If you do not agree to these Terms, do not access or use the Platform.

1. definitions.

"Platform Materials" means all content made available to User through the Platform, including reports, dashboards, briefings, scores, classifications, visualizations, datasets, exports, and any derivative works thereof.

"Frameworks" means Civic Liturgy's proprietary analytic frameworks, indices, and scoring systems, including (without limitation) the Barmen Index, Christian Nationalism Index, Red Letter Index, Moral Foundations measures, Empathy Index, Relationality Index, Cultural Position Index, Domain Impact Scores, Sermon Topic Allocation, Population Pastoral Coverage, Legislative Analysis Framework, Municipal and School District Assessment Frameworks, Enculturation Gap Analysis, Community-Sermon Gap Analysis, the 7-13-7 framework, and any successor, refinement, or derivative thereof.

"User Content" means any information, data, files, comments, or feedback provided by User to Civic Liturgy through the Platform or otherwise in connection with these Terms.

2. grant of access; license.

Subject to User's continued compliance with these Terms, Civic Liturgy grants User a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform and Platform Materials solely for User's internal review, evaluation, research, or stated business purpose. No other rights are granted, whether by implication, estoppel, or otherwise.

3. restrictions.

User shall not, and shall not permit any third party to:

  • (a) copy, modify, distribute, sell, lease, sublicense, publish, or otherwise make the Platform or Platform Materials available to any third party, except as expressly permitted in writing by Civic Liturgy;
  • (b) reverse engineer, decompile, disassemble, scrape, crawl, harvest, or otherwise attempt to derive the source code, prompts, prompt templates, system instructions, scoring weights, model parameters, database schemas, or underlying methodology of the Platform or the Frameworks;
  • (c) use the Platform or Platform Materials to develop, train, evaluate, benchmark, or improve any competing product, service, dataset, model, or framework;
  • (d) input, submit, upload, or otherwise transmit any Platform Materials into any third-party artificial intelligence, machine learning, generative AI, large language model, or similar service or tool except under enterprise, zero-retention, or comparable contractual terms that prohibit operator use of inputs and outputs for training;
  • (e) remove, alter, or obscure any proprietary notices, attribution, watermarks, version identifiers, or methodology footers contained in the Platform or Platform Materials;
  • (f) republish, redistribute, or quote Platform Materials publicly without (i) prior written approval from Civic Liturgy for any quotation exceeding fifty (50) words from a single report or briefing, and (ii) attribution in the form "Source: civic liturgy. (civicliturgy.com)";
  • (g) use the Platform or Platform Materials in any manner that violates applicable law, infringes the rights of any third party, defames any person or organization, or is otherwise misleading or deceptive; or
  • (h) interfere with, disrupt, or attempt to gain unauthorized access to the Platform or any networks, systems, or accounts connected to the Platform.

4. intellectual property.

As between the Parties, Civic Liturgy owns and retains all right, title, and interest in and to the Platform, the Platform Materials, the Frameworks, and all underlying software, code, prompts, models, database schemas, datasets, methodologies, taxonomies, scoring logic, and documentation, together with all intellectual property rights therein (including patent, copyright, trademark, trade secret, and database rights). All rights not expressly granted under these Terms are reserved by Civic Liturgy. The civic liturgy. name and brand, the lowercase wordmark, and any associated logos are trademarks of Civic Liturgy, LLC and may not be used without prior written consent.

5. user content; feedback license.

User retains ownership of User Content but grants Civic Liturgy a non-exclusive, worldwide, royalty-free, fully paid-up, sublicensable, perpetual, and irrevocable license to use, reproduce, modify, create derivative works from, and incorporate User Content into the Platform and Platform Materials solely as reasonably necessary to provide, operate, evaluate, and improve the Platform.

With respect to any suggestions, ideas, feedback, error reports, feature requests, or proposed improvements that User provides (collectively, "Feedback"), User grants Civic Liturgy a non-exclusive, perpetual, irrevocable, royalty-free, fully paid-up, transferable, and sublicensable license to use, exploit, and commercialize such Feedback in any manner and for any purpose, without any obligation, attribution, or compensation to User.

6. confidentiality.

All non-public information about the Platform, Platform Materials, Frameworks, methodologies, scoring weights, prompts, roadmap, pricing, and any pre-publication reports, briefings, or analyses is the confidential information of Civic Liturgy ("Platform Confidential Information"). User shall hold Platform Confidential Information in strict confidence, use it only for the purposes permitted under these Terms, and protect it with at least the same degree of care it uses to protect its own confidential information of like importance (but in no event less than reasonable care). If User and Civic Liturgy have entered into a separate non-disclosure agreement, the terms of that agreement supplement these Terms; in the event of conflict, the more protective terms control.

7. public data sources; research nature.

Civic Liturgy is a civic intelligence research platform. Platform Materials are analytic and interpretive in nature and are derived from publicly available source materials, including:

  • (a) sermons, homilies, teachings, and pulpit recordings that have been published or distributed publicly by their speakers or sponsoring organizations (including via church websites, podcast feeds, YouTube and similar video platforms, livestreams, and other public-facing channels);
  • (b) recordings, minutes, agendas, and records of public meetings of municipal, school district, county, state, and federal governmental bodies (including city councils, school boards, legislative committees, and public hearings);
  • (c) bills, statutes, votes, amendments, and other legislative records and documents maintained by state and federal governmental authorities and made available through public databases;
  • (d) publicly filed corporate, nonprofit, ecclesiastical, and organizational records, including IRS filings, Secretary of State filings, and similar public records;
  • (e) demographic, economic, and statistical data published by the U.S. Census Bureau and other public sources; and
  • (f) other materials placed in the public domain or made publicly available by their creators or by operation of law.

Civic Liturgy does not collect, store, or analyze private communications, non-public records, or personal data, except as reasonably necessary to identify public-facing speakers, officials, organizations, and entities by name and role. To the extent any Platform Materials reference identifiable individuals (such as pastors, elected officials, candidates, or other public figures), such reference is made in the context of their public roles, public statements, and public conduct, consistent with established research, journalistic, and public-commentary norms.

User acknowledges that: (a) Platform Materials are not legal, financial, medical, theological, or political advice; (b) Platform Materials may contain inferences, classifications, and probabilistic judgments; (c) scoring and classifications are intended for research and decision-support purposes only; (d) User is solely responsible for any reliance placed on Platform Materials and for verifying source materials independently when appropriate; and (e) Civic Liturgy makes no representation or warranty as to the accuracy, completeness, currency, or availability of underlying public source materials, which depend on the third parties making such materials publicly available.

8. third-party services and subprocessors.

Civic Liturgy operates the Platform with the assistance of third-party service providers, data sources, and infrastructure vendors (collectively, "Subprocessors"), which may include, without limitation:

  • (a) legislative and governmental data providers (for example, LegiScan and similar services that aggregate and make available public legislative records);
  • (b) demographic, statistical, and geographic data providers (for example, the U.S. Census Bureau);
  • (c) audio and video transcription and speech-recognition services (for example, AssemblyAI and Supadata);
  • (d) artificial intelligence, machine learning, and language model providers (for example, Anthropic, OpenAI, and OpenRouter), used as production tooling and subject to applicable enterprise, batch, or zero-retention terms;
  • (e) database, hosting, infrastructure, content-delivery, and deployment providers (for example, Supabase and Vercel);
  • (f) workflow, automation, and orchestration platforms (for example, n8n);
  • (g) discovery, mapping, and metadata services (for example, Outscraper and similar location-data services); and
  • (h) such other vendors, contractors, and service providers as Civic Liturgy may engage from time to time in its reasonable business judgment.

Civic Liturgy makes commercially reasonable efforts to engage Subprocessors that maintain appropriate confidentiality, security, and data-handling practices. However, Civic Liturgy does not warrant, and shall not be responsible for, the acts, omissions, accuracy, performance, availability, security, terms of service, or business practices of any Subprocessor. The use of Subprocessors does not create any contractual relationship between User and any Subprocessor, nor does it grant User any right or remedy against any Subprocessor. The illustrative list above may change without notice; Civic Liturgy will maintain a current list of material Subprocessors available upon reasonable written request.

9. pre-release and beta features.

From time to time, Civic Liturgy may make pre-release, alpha, beta, preview, evaluation, or experimental features available to User ("Beta Features"). Beta Features are provided "as is" and "as available," may be incomplete, unstable, or modified or discontinued at any time without notice, and are not subject to any service-level commitments. User's use of Beta Features is voluntary and at User's sole risk. All Beta Features and any related information are deemed Platform Confidential Information.

10. disclaimer of warranties.

THE PLATFORM AND PLATFORM MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, OR AVAILABILITY. CIVIC LITURGY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY DEFECTS WILL BE CORRECTED. CIVIC LITURGY MAKES NO WARRANTY AS TO ANY DATA, OUTPUT, RESULT, ANALYSIS, OR CLASSIFICATION OBTAINED THROUGH OR DERIVED FROM ANY SUBPROCESSOR OR PUBLIC SOURCE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY CIVIC LITURGY OR ITS REPRESENTATIVES SHALL CREATE ANY WARRANTY.

11. limitation of liability.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CIVIC LITURGY OR ITS OFFICERS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE TO USER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THESE TERMS OR USER'S USE OF THE PLATFORM, EVEN IF CIVIC LITURGY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CIVIC LITURGY'S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY USER TO CIVIC LITURGY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

12. indemnification.

User shall defend, indemnify, and hold harmless Civic Liturgy and its officers, members, employees, and agents from and against any and all third-party claims, losses, liabilities, damages, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) User's breach of these Terms, (b) User's use or misuse of the Platform or Platform Materials, (c) User Content, or (d) User's violation of any law or third-party right.

13. term; termination; effect.

These Terms commence upon User's acceptance and continue until terminated. Civic Liturgy may suspend or terminate User's access to the Platform at any time, with or without cause and with or without notice. Upon termination, User shall (a) immediately cease all use of the Platform and Platform Materials, (b) destroy or return all Platform Materials and Platform Confidential Information in User's possession or control, and (c) certify such destruction or return in writing upon request. Sections 3, 4, 5, 6, 7, 8, 10, 11, 12, and 14 shall survive termination.

14. changes to terms.

Civic Liturgy may modify these Terms from time to time. Material changes will be communicated to User via email or through the Platform. User's continued use of the Platform after the effective date of any modification constitutes acceptance of the modified Terms. If User does not agree to the modified Terms, User must cease use of the Platform.

15. governing law; venue; jury waiver.

These Terms are governed by and shall be construed in accordance with the laws of the State of Arkansas, without regard to its conflict-of-laws principles. The Parties consent to the exclusive jurisdiction of the state and federal courts located in Benton County, Arkansas, and waive any objection to venue therein. Each Party irrevocably waives its right to a trial by jury in any action arising out of or relating to these Terms.

16. miscellaneous.

16.1 Entire Agreement

These Terms, together with any separately executed non-disclosure agreement, statement of work, or order form between the Parties, constitute the entire agreement of the Parties with respect to their subject matter and supersede all prior or contemporaneous communications and agreements relating thereto.

16.2 Assignment

User may not assign these Terms without Civic Liturgy's prior written consent. Civic Liturgy may assign these Terms without consent in connection with a merger, reorganization, or sale of all or substantially all of its assets or business.

16.3 Severability; Waiver

If any provision is held unenforceable, the remainder shall remain in full force and effect. No waiver is effective unless in writing.

16.4 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

16.5 Notices

16.6 Electronic Signatures

These Terms may be accepted by electronic signature, click-acceptance, or signed counterpart, each of which is deemed an original.

By accessing the Platform

By accessing the Platform or otherwise indicating your acceptance, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and Platform Access Agreement, and you represent that you have the authority to enter into these Terms on behalf of the entity (if any) you represent.
